College, University, Corporation, Government Agency DVD
(or file) and
3 Year Site/Local Streaming License |
|
In consideration for payment received for this license, Licensor (California Newsreel) will send the Licensee (the purchasing
institution) a DVD (or file(s) depending on the title) of the title and grant the Licensee the right to encode
streaming files of the title from that source for use on the Licensee's
streaming server. The Licensee may also present a copy of their active certificate of license from the email address on the order to request digital files for use in seting up streaming. The title may be streamed on the Licensee's password protected
streaming server to studenst, faculty and staff for a period of 3 years from the
date of purchase. In addition, Licensee may use the DVD (when provided), in activities directly administered by the Licensee (the purchaser), including in-class instruction, course-management software, library reference, distance learning, extracurricular programming and performances open to the public provided no admission is charged (public performance)
for the life of the DVD. Streaming without password protection to the larger web
or via youtube are prohibited under this license.
The Licensee undertakes that it will not telecast, cablecast or deliver digitally from any website open to the public any of the content licensed under this agreement, nor will it sell, rent, loan or donate any of the licensed content to any individual, organization or institution, including affiliates in a multi-site system, members of a media consortium or participants under an inter-library loan agreement.. |

High Schools, Public Libraries, HBCUs and Qualifying Community Organization Discounted DVD License Without Streaming Rights |
|
As part of its non-profit commitment to promoting the widest possible use of its resources, California Newsreel offers DVDs to high schools, public libraries, Historically Black Colleges and Universities (HBCUs) and qualifying community organizations, such as church groups, labor unions, neighborhood associations and civic groups, at sharply discounted prices. To qualify for this discount, orders must be from or on behalf of institutions which fall into the above categories, as demonstrated by an order on that institution’s letterhead or which ships to the address of such a qualifying institution. California Newsreel reserves the right to make the final determination whether an institution qualifies for this discount.
Purchase of a DVD at the Discounted DVD License Without Streaming Rights price constitutes the purchaser’s agreement to the following terms of use. In consideration for payment received Licensor (California Newsreel) will send a DVD of the title and grant the Licensee (the purchaser) the right to screen the DVD purchased for its useful life in programs directly administered by the Licensee, including instruction, library circulation, client and constituent services as well as in exhibitions open to the public where no admission is charged (public performance).
Licensee undertakes that it will not copy, loan, rent, sell or donate the DVD to any other individual, organization or institution, including affiliates in a multi-site system, members of a media consortium or participants in an inter-library loan agreement. Explicitly excluded from this grant of rights is the right to copy or encode the purchased DVD, in whole or in part, as a digital file or to deliver any of its contents by broadcast, cablecast or any form of digital delivery. For all digital uses, Licensee must purchase one of the full-price digital licenses offered by the Licensor (California Newsreel) and its authorized digital distribution partners. |

Home Video DVD License |
|
Purchase of a DVD at the home Video License price constitutes the purchaser’s agreement to the following terms of use. In consideration for payment received, the Licensor (California Newsreel) will send the Licensee (the purchaser) a DVD of the title purchased and grants him or her the right to screen the purchased DVD to friends and family in private, i.e. non-institutional settings, for the useful life of the DVD. The Licensee agrees that he or she will not rent, sell or donate this DVD to any individual, institution or organization nor allow it to be screened as part of any program of formal instruction, professional practice, in-service training, public advocacy or as a performance open to the general public (public performance). Explicitly excluded from this grant of rights is the right to copy the purchased DVD, to encode its contents into a digital file or to deliver its content by broadcast, cablecast, internet or any form of digital delivery. For any institutional use, an appropriate institutional license must be purchased. In addition, video-on-demand subscriptions and digital rentals are available for many titles through California Newsreel’s distribution partners. |

Preview |

Most videos may be previewed on Vimeo On Demand for a small rental fee. DVDs may be purchased by educational institutions and community organizations on-approval. This means you may return a non-defective DVD if you have previewed it but cannot use it in a classroom or organizing context. DVDs used in these contexts may not be returned under this policy. DVDs purchased for home use may not be returned for this purpose. Returns must be sent using the return slip attached to your orders packing slip and they should be sent to: California Newsreel Returns Department, 44 Gough Street, Suite 303, San Francisco, CA 94103. |

Purchase Orders |

Purchase orders are accepted from colleges, universities, government agencies, museums, corporation, high schools and public libraries only. All other individuals and organizations must prepay by check, money order, Visa or Mastercard. Purchase orders must specify the address and telephone number of the accounts payable department or responsible person at each institution. |
